  • Retail fraud in the first degree: Five years prison and a fine of up to $10,000 or three times of the value of the property stolen (whichever is greater).
  • Retail fraud in the second degree: One year in prison and a fine of up to $2,000 or three times the value of the property stolen (whichever is greater).
  • Retail fraud in the third degree: Ninety-three days in prison and a fine of up to $500 or three times the value of the property stolen (whichever is greater).
